Judge Affirms Digital Type Copyright

SAN JOSE, Calif. (05 Feb 1998)—A U.S. District Court judge has ruled that font outlines are copyrightable.

Judge Ronald Whyte affirmed this week that type designers use "creativity in designing ... font software programs" and base their creative decisions on "the image in front of them on the computer screen."

Judge Whyte's ruling came in a longstanding case brought by Adobe Systems against a Florida company alleged to have used other designers' typeface files to make its own font packages. The ruling doesn't address the actual font designs, only the software that creates them.

"We're all very happy with the news," said a TypeRight spokesman.
